AOP3D LEGAL DISCLAIMER, WARRANTY, AND TERMS OF SERVICE

PREAMBLE

 

This document ("Agreement") constitutes a legally binding agreement between AOP3D ("Company," "We," "Us," or "Our"), and you, the client ("Client," "You," or "Your"). This Agreement governs your access to and use of AOP3D's various professional services, including but not limited to Digital Data Scrubbing, Technical Support, Data Retrieval, and IT Consulting (collectively, the "Services").

AOP3D is a strictly service-based entity. We do not sell, manufacture, or warranty hardware, laptops, or physical products.

By engaging with or utilizing any of AOP3D’s Services, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions contained herein. If you do not agree to these terms, you must not use Our Services.


 

I. GENERAL TERMS AND CONDITIONS

 

1. Eligibility: You represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into this Agreement.

2. Modifications: AOP3D reserves the right to modify this Agreement at any time. Your continued use of Services following any changes constitutes acceptance of those changes.

3. Governing Law: This Agreement shall be governed by the laws of the Commonwealth of Massachusetts. The parties agree that the courts located in Essex County, Massachusetts, shall have exclusive jurisdiction to settle any dispute.

4. Force Majeure: AOP3D shall not be liable for any failure to perform services due to causes beyond Our reasonable control, including acts of God, internet outages, power failures, or government actions.


 

II. DIGITAL DATA SCRUBBING SERVICES

 

This section outlines the scope of work, limitations, and authorization regarding digital data scrubbing services provided by AOP3D.

1. Scope of Services AOP3D agrees to perform the following "Data Scrubbing" services on behalf of the Client:

  • Data Broker Opt-Outs: AOP3D will identify and submit removal requests to major third-party data aggregators (e.g., Whitepages, Spokeo, BeenVerified, and similar).

  • Search Engine Clean-up: AOP3D will submit requests to search engines (specifically Google) to remove results containing personally identifiable information (PII) where applicable under their privacy policies.

  • Social Media Audit: AOP3D will review specified social media accounts and recommend privacy setting adjustments to reduce public visibility.

2. Limitations of Service & Disclaimer The Client acknowledges the following limitations regarding the removal of information from the internet:

  • Public Records: AOP3D cannot remove official government public records. This includes, but is not limited to: Property deeds, voter registration, court records, marriage licenses, and traffic citations. These are maintained by government entities and are public by law.

  • Re-population: Data brokers frequently "scrape" data. Information removed today may reappear in the future. AOP3D is not responsible for third-party sites re-listing information after the initial removal service is complete, unless a recurring maintenance plan is agreed upon.

  • No Guarantee of Total Anonymity: While AOP3D will make every professional effort to reduce the Client's digital footprint, total removal from the internet is not possible.

3. Client Authorization The Client grants AOP3D the limited authority to act as their agent for the sole purpose of data removal. This includes:

  • Creating temporary email addresses on the Client's behalf to manage opt-out verifications.

  • Contacting third-party data brokers and representing the Client to request data deletion.

  • Submitting forms to search engines using the Client's information.

4. Confidentiality AOP3D agrees that all personal information provided by the Client (dates of birth, addresses, phone numbers, etc.) will be used strictly for the purpose of locating and removing data. AOP3D will not sell, share, or distribute Client data to any third party.


 

III. TECH SUPPORT SERVICES AGREEMENT

 

1. Nature of Services AOP3D provides technical support, diagnosis, and consulting. Because of the complex nature of technology, AOP3D cannot guarantee that every issue can be resolved. The initial description of a problem provided by the Client is a starting point; AOP3D reserves the right to adjust the scope of work as the diagnosis progresses.

2. Data Backup – CRITICAL NOTICE THE CLIENT IS SOLELY RESPONSIBLE FOR BACKING UP ALL DATA PRIOR TO SERVICE. AOP3D shall not be liable for any loss, corruption, or compromise of Client data, files, or software unless caused by the gross negligence of AOP3D.

3. Payment Terms

  • Diagnostic/Initial Fee: A mandatory minimum fee (agreed upon at booking) is due for the initial diagnosis or first hour of service. This fee covers the labor and expertise required to assess the issue, regardless of whether a full resolution is achieved.

  • Payment Due: Payment is due immediately upon signing or upon completion of the service as specified in the work order.

4. Abandoned Devices Any devices left with AOP3D for more than sixty (60) days after notification of service completion (or impossibility of repair) will be considered abandoned and may be disposed of in accordance with Massachusetts law to recover storage and service costs.


 

IV. DATA RETRIEVAL SERVICES

Note: This differs from "Data Scrubbing." This section applies when you ask us to recover lost files from a broken device.

1. No Guarantee Data recovery is not always successful. AOP3D makes no guarantee regarding the percentage or integrity of data that can be recovered from failing media.

2. Confidentiality AOP3D will not view Client file contents except as strictly necessary to verify the success of the transfer.

3. Limitation of Liability If data is deemed unrecoverable, or if the drive fails completely during the attempt due to its pre-existing fragile state, AOP3D is not liable for the data loss.


 

V. SERVICE SUBSCRIPTIONS (If Applicable)

1. Automatic Renewal If you enroll in a recurring maintenance or support plan, your subscription will automatically renew for successive periods unless you notify AOP3D in writing of your intent to cancel prior to the renewal date.

2. Cancellation You may cancel subscriptions in accordance with the terms of your specific plan. Early termination of annual contracts may incur a fee.


 

VI. REFUND AND CANCELLATION POLICY

 

1. Services are Non-Refundable Fees associated with Data Scrubbing, Tech Support, Diagnostic Services, and Labor, and are for the time and expertise rendered. As such, these fees are generally non-refundable once the service has commenced or the work has been performed.

2. Cancellations If you cancel a scheduled appointment with less than 24 hours' notice, a cancellation fee may apply.

3. No Hardware Returns As AOP3D does not sell hardware, there are no physical product returns handled by AOP3D. Any software licenses purchased on your behalf are subject to the refund policy of the software manufacturer.


 

VII. LIMITATION OF LIABILITY & INDEMNIFICATION

 

1. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY MASSACHUSETTS LAW, AOP3D’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY THE CLIENT FOR THE SPECIFIC SERVICE ENGAGEMENT. AOP3D SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF DATA OR PROFITS).

2. INDEMNIFICATION The Client agrees to indemnify and hold harmless AOP3D from any claims, liabilities, or expenses arising out of the Client’s misuse of services, breach of this Agreement, or provision of illegal/unlicensed software or data to AOP3D.
