AOP3D Master Legal Agreement: Terms of Service & Website Terms of Use

Preamble & Acceptance of Terms
This document ("Agreement") constitutes a legally binding, irrevocable agreement between AOP3D, Adam Master, and any affiliated entities or personnel (located at 5 Whistlestop Mall, Rockport, MA 01966) (collectively, "AOP3D," "Company," "We," "Us," or "Our"), and you, the client or website visitor ("Client," "User," "You," or "Your"). This Agreement governs your access to and use of AOP3D's services, including tech support, refurbished equipment sales, procurement assistance, software warranties, data retrieval, and your use of AOP3D.COM (collectively, the "Services").
BY ENGAGING WITH, PURCHASING FROM, BROWSING AOP3D.COM, OR UTILIZING ANY OF AOP3D’S SERVICES, YOU UNEQUIVOCALLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY EVERY TERM CONTAINED HEREIN. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOUR SOLE RECOURSE IS TO IMMEDIATELY CEASE USE OF OUR SERVICES AND WEBSITE.
I. General Terms & Maximum Protection Clauses

1. Right to Refuse Service: AOP3D and Adam Master reserve the absolute, unilateral right to refuse service, terminate accounts, block website access, cancel orders, or end tech support sessions at our sole discretion, at any time, for any reason, without liability or penalty.

2. Mandatory Binding Arbitration & Class Action Waiver (CRITICAL): Any dispute, claim, or controversy arising out of or relating to this Agreement, the Services, or any products sold by AOP3D shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court in Essex County, Massachusetts, if your claims qualify.

Class Action Waiver: YOU AND AOP3D AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims. By agreeing to these terms, you are waiving your right to a trial by jury.

3. Absolute Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY MASSACHUSETTS LAW, IN NO EVENT SHALL AOP3D, ADAM MASTER, OR THEIR EMPLOYEES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OUR SERVICES, WEBSITE, OR PRODUCTS. AOP3D'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THIS AGREEMENT SHALL BE STRICTLY CAPPED AT THE TOTAL AMOUNT YOU PAID TO AOP3D FOR THE SPECIFIC SERVICE OR PRODUCT GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS PRECEDING THE INCIDENT.

4. Comprehensive Indemnification: You agree to fully indemnify, defend, and hold harmless AOP3D and Adam Master from any and all claims, demands, losses, liabilities, and expenses (including attorney's fees) arising out of your use of the Services, your browsing of the Website, your breach of this Agreement, or your violation of any law or the rights of a third party.
II. Tech Support & Service Execution

1. Unpredictability of Technology: Technological systems are volatile. The Client's initial description of a problem is merely a starting point. AOP3D explicitly reserves the right to unilaterally alter the scope of work, diagnostic procedures, and proposed solutions without prior notice if emerging technical realities demand it.

2. No Guarantee of Resolution: While AOP3D employs professional expertise, we absolutely DO NOT GUARANTEE that any specific issue can or will be resolved. You are paying for our time, expertise, and diagnostic labor, not a guaranteed outcome. Initial service fees and diagnostic fees are strictly non-refundable, regardless of whether the device is successfully repaired.

3. Abandoned Property: Any device left in the possession of AOP3D for more than thirty (30) days following notice of completion or diagnosis shall be deemed legally abandoned. AOP3D reserves the right to wipe, sell, recycle, or dispose of the equipment to recoup storage and labor costs, with zero liability or compensation owed to the Client.
III. Data Retrieval & The "Zero Liability" Data Clause

1. Client's Sole Responsibility for Data: YOU ARE EXCLUSIVELY RESPONSIBLE FOR BACKING UP YOUR DATA PRIOR TO HANDING OVER ANY DEVICE. AOP3D assumes your data is already backed up elsewhere.

2. Absolute Data Loss Waiver: By submitting a device for service, you acknowledge that data recovery and hardware repair are inherently destructive processes. AOP3D AND ADAM MASTER ASSUME ABSOLUTELY ZERO LIABILITY FOR THE LOSS, CORRUPTION, COMPROMISE, OR LEAK OF ANY DATA, REGARDLESS OF THE CAUSE, INCLUDING ALLEGED NEGLIGENCE ON THE PART OF AOP3D. * 3. Presumption of Prior Corruption: If files are missing post-recovery, it is legally presumed they were corrupted or destroyed prior to AOP3D's intervention.
IV. Hardware Procurement ("Order It 4 Me") & Refurbished Sales

1. "AS-IS" Refurbished Sales: All refurbished equipment is sold strictly "AS-IS" and "WITH ALL FAULTS." AOP3D explicitly disclaims all implied warranties, including fitness for a particular purpose. Cosmetic imperfections, degraded battery life, and aged audio components are expected and do not constitute grounds for a refund.

2. Procurement Agent Exemption: For the "Order It 4 Me" service, AOP3D acts solely as an ordering agent. The contract of sale is between you and the Third-Party Retailer (e.g., Amazon). AOP3D bears zero liability for shipping delays, damaged goods, defective hardware, or retailer disputes. Our Service Fee for placing the order is strictly non-refundable once the order is submitted.
V. Software Warranty Limitations
If a One-Year Software Limited Warranty is explicitly provided in writing at the time of sale, it covers ONLY AOP3D-installed operating systems.

Immediate Voidance: This warranty is immediately and irrevocably voided if the Client installs unauthorized third-party software, downloads malware, visits high-risk websites, or attempts to modify the registry/OS files.

Hardware Exclusion: This warranty covers software exclusively. AOP3D will not entertain software warranty claims that are caused by underlying, post-sale hardware failures.
VI. Website Terms of Use, Digital Access & Affiliate Disclaimer

Absolute Disclaimer of Information & Content: All content provided on AOP3D.COM, whether authored by Adam Master, "The Wizard," or any AOP3D team member, is strictly for informational, educational, and entertainment purposes only. AOP3D makes absolutely no representations, warranties, or guarantees regarding the accuracy, completeness, or validity of any information on this site or found by following any third-party link. You consume this content entirely at your own risk.

2. Technology, Hardware Modification & "Bricked Device" Waiver: All technical guides, registry edits, and repair advice on AOP3D.COM are provided strictly "as-is." You unequivocally acknowledge that modifying hardware or software carries severe inherent risks. Under no circumstances shall AOP3D or Adam Master be held financially or legally liable for any damaged hardware, "bricked" devices, catastrophic loss of data, system failures, personal injury, or voided warranties resulting directly or indirectly from following the tutorials or advice provided on this Website.

3. Digital Tools, Software & Widgets: The download, installation, and utilization of any tools or scripts from this Website are executed at your sole discretion and absolute risk. AOP3D expressly disclaims all implied warranties regarding these tools and shall not be liable for any malware, system corruption, or data breaches alleged to have originated from their use.

Data Harvesting, Privacy & Analytics Compliance: AOP3D automatically collects non-personal technical telemetry (including IP addresses, browser fingerprints, and geographic data) via cookies and third-party analytics. Users may request access to or deletion of their personal data in writing, subject to legal exemptions.

If you click an affiliate link and consummate a purchase, AOP3D receives a financial commission at no additional cost to you.

All such content represents the protected, professional opinion of AOP3D based on available evidence. This content is published strictly under the legal doctrine of Fair Comment for the purposes of public interest criticism and education, and is not intended to maliciously defame any individual or corporate entity.
VII. Final Provisions

1. Severability: If any provision of this Agreement is found to be unenforceable by a court of competent jurisdiction, that specific provision shall be severed, and the remainder of the Agreement shall remain in full force and effect, interpreted to maximize the protection of AOP3D.

2. Entire Agreement: This document constitutes the entire agreement between you and AOP3D/Adam Master, superseding all prior verbal or written communications. No employee of AOP3D is authorized to verbally alter these terms.
